Please read these Terms and Conditions (“Terms”, “Terms of Use”) carefully before using the website www.payyouadvisory.com (“Website”) owned and operated by Payyou Advisory Private Ltd. (“Company”, “PayYou Advisory”, “we”, “us”, “our”). By accessing, browsing, or using this Website, submitting an enquiry, or availing any service offered through it, you (“User”, “Customer”, “you”) agree to be bound by these Terms and by our Privacy Policy set out in Part B below. If you do not agree with any part of these Terms, please do not use this Website.

2. Our Role — We Are Not a Bank, NBFC, or Lender

Payyou Advisory Private Ltd. is a loan referral and advisory platform. We function as a Direct Selling Agent (DSA) / Lending Service Provider (LSP) for our partner banks and NBFCs. We are NOT a bank, NBFC, or lender, and we do not sanction, disburse, or fund any loan or credit facility ourselves. Our role is limited to:

All decisions relating to loan eligibility, sanction, interest rate, tenure, processing fee, and disbursement rest solely and exclusively with the concerned Lending Partner, based on their own credit policy, underwriting norms, and applicable RBI guidelines. Nothing on this Website constitutes a loan offer, sanction letter, or guarantee of approval by the Company.

3. No Guarantee of Loan Approval

Submission of an enquiry or application through this Website does not guarantee that your loan will be approved, sanctioned, or disbursed. Approval is subject to the Lending Partner’s independent assessment of your credit profile, CIBIL/credit bureau score, income documents, KYC verification, and internal policy, and may be declined at the sole discretion of the Lending Partner without assigning any reason.

4. Eligibility

You must be at least 18 (eighteen) years of age and competent to enter into a valid contract under the Indian Contract Act, 1872 to use this Website or avail our Services. By using the Website, you represent and warrant that you meet this eligibility criterion and that all information you provide is true, accurate, current, and complete.

5. Fees and Charges

PayYou Advisory does not charge the Customer any upfront fee for referral or advisory services unless otherwise expressly disclosed to and agreed with you in writing before you avail such services. Any processing fee, documentation charge, interest, prepayment charge, or other cost associated with the loan or credit facility itself is levied solely by the concerned Lending Partner as per their sanction letter/Key Fact Statement, and the Company does not control or benefit from such charges beyond any referral commission paid to it by the Lending Partner. Please verify all fees and charges directly from the Key Fact Statement issued by your Lending Partner before accepting any loan offer.

6. Multiple Lending Partners and Key Fact Statement

In line with the Reserve Bank of India’s Digital Lending Directions, where more than one Lending Partner’s product may match your loan requirement, we will make reasonable efforts to present you with the relevant options along with the name of the Lending Partner, indicative loan amount, tenure, Annual Percentage Rate (APR), and a link to or copy of the Key Fact Statement for each offer, so that you can make an informed decision. You are strongly advised to read the Key Fact Statement and loan agreement carefully before accepting any offer.

7. No Handling of Loan Funds

The Company does not receive, hold, or disburse loan proceeds, EMI payments, or repayments on behalf of any Lending Partner or Customer. All disbursement of sanctioned loan amounts is made directly by the Lending Partner into your bank account, and all repayments/EMIs must be made by you directly to the Lending Partner through the channel specified by them. The Company will never ask you to transfer loan proceeds, margin money, or “processing fee in advance” to any personal bank account, UPI ID, or wallet.

8. Right to Exit / Cooling-Off Period

As per the Reserve Bank of India’s digital lending framework, you are entitled to a cooling-off / look-up period (as specified by the respective Lending Partner, subject to a regulatory minimum) during which you may exit the loan by paying the principal and proportionate Annual Percentage Rate, without any penalty. Please refer to the Key Fact Statement of your specific Lending Partner for the exact cooling-off period applicable to your loan.

9. Consent to Be Contacted

By submitting your details on this Website (including through any enquiry form, callback request, or WhatsApp chat), you expressly consent and authorise PayYou Advisory, its employees, representatives, and its Lending Partners to contact you via phone call, SMS, WhatsApp, RCS, e-mail, or other electronic means, for the purpose of understanding your requirement, processing your application, sending reminders, and informing you of related products and offers — including where your mobile number is registered under the National Customer Preference Register (NCPR)/Do Not Disturb (DND) service — to the extent permitted by applicable law (including TRAI regulations). You may withdraw this consent at any time as described in Part B (Privacy Policy), Clause 10.

You understand and agree that, to process your loan enquiry, the Company and its Lending Partners may need to collect and verify your Know Your Customer (KYC) documents, obtain your credit report/score from TransUnion CIBIL or other RBI-authorised Credit Information Companies, and share your Personal Information and Sensitive Personal Data with the relevant Lending Partner(s), strictly on a need-to-know basis and in accordance with Part B (Privacy Policy) of this document. Your consent for accessing your credit information report is taken separately and specifically before such access, and you may decline to give such consent, in which case we may not be able to process your loan enquiry with certain Lending Partners.

All content on this Website — including text, graphics, logos, the “PayYou Advisory” name and mark, layout, and software — is the property of the Company or its licensors and is protected under applicable Indian copyright, trademark, and intellectual property laws. You may view and print pages of this Website for your personal, non-commercial use only. No content may be copied, reproduced, republished, uploaded, modified, or distributed in any form without our prior written permission.

This Website may contain links to the websites of our Lending Partners or other third parties. These links are provided for your convenience only. The Company does not control, endorse, or assume any responsibility for the content, accuracy, terms, or privacy practices of any third-party website, and your interaction with any Lending Partner or other third party — including the actual loan agreement — is strictly between you and that party. In accordance with the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and the Reserve Bank of India’s guidelines on digital lending grievance redressal, if you have any complaint or grievance relating to the Website, our Services, or the handling of your Personal Information, you may write to our Grievance Officer at the details below. We will endeavour to acknowledge your grievance promptly and resolve it within the timelines prescribed under applicable law.

20. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to Clause 21 (Dispute Resolution) below, the courts at Pune, Maharashtra shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

21. Dispute Resolution

In the event any dispute is not resolved through our grievance redressal mechanism within thirty (30) days, either party may refer the dispute to arbitration by a sole arbitrator mutually appointed, to be conducted in English, with the seat and venue of arbitration at Pune, Maharashtra, in accordance with the Arbitration and Conciliation Act, 1996. Nothing in this clause shall prevent either party from seeking interim relief before a court of competent jurisdiction.

22. Amendment of Terms

We may revise these Terms and the Privacy Policy from time to time to reflect changes in our practices, our Services, or applicable law (including the Digital Personal Data Protection Rules, 2025 and RBI’s digital lending directions, as amended). The “Last Updated” date at the top of this page will indicate when the Terms were last revised. Your continued use of the Website after such changes are posted constitutes your acceptance of the revised Terms. For material changes, we will provide a more prominent notice on the Website.

23. Severability and Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be severed, and the remaining provisions shall continue in full force and effect. However, no method of transmission over the internet or electronic storage is 100% secure, and while we strive to protect your Personal Data, we cannot guarantee its absolute security.

We retain your Personal Data only for as long as necessary to fulfil the purpose for which it was collected, to comply with our legal, regulatory, and record-keeping obligations (including under RBI and PMLA norms), or to resolve disputes and enforce our agreements — after which it is securely deleted or anonymised. Credit bureau data (e.g., CIBIL reports accessed by us) is retained only for as long as reasonably necessary for the purpose of your loan enquiry. You may request erasure of your Personal Data at any time, as described in Clause 12 below, subject to our legal retention obligations.

On receiving such a request, we will stop using your data for the purposes for which consent was withdrawn and will delete it, except to the extent we are required by law to retain it (for example, transaction records under RBI/PMLA norms).

Where verification is required for your loan application, it is carried out only through authorized channels, your Lending Partner’s regulated e-KYC process, or masked/redacted documentation, and only with your explicit, specific consent for that purpose.

Our Services are intended only for individuals who are at least 18 years of age and legally competent to contract. We do not knowingly collect Personal Data from anyone below this age. If we become aware that we have inadvertently collected data from a minor, we will delete such data promptly. Where processing of a minor’s or a person with disability’s data is unavoidable and legally permitted, we will obtain verifiable consent from a parent or lawful guardian, in accordance with the DPDP Rules, 2025.

In the unlikely event of a personal data breach, we will take prompt remedial action and notify the Data Protection Board of India and affected Data Principals in the manner and within the timelines prescribed under the DPDP Rules, 2025.
